These Terms of Service (the “Terms”) govern your access to and use of https://consumerlit.com (the “Site”), which is published by Consumer Lit, a California law firm (“Consumer Lit,” “the firm,” “we,” “us,” or “our”). By accessing or using the Site, or by submitting any inquiry through the Site, you agree to be bound by these Terms. If you do not agree to these Terms, you should not use the Site.
1. Attorney Advertising
The information contained on the Site constitutes attorney advertising within the meaning of the California Rules of Professional Conduct, including Rule 7.1, and the rules of any other jurisdiction in which it may be viewed. The choice of an attorney is an important decision and should not be based solely upon advertisements.
2. No Legal Advice
The Site is provided for general informational purposes only and does not constitute legal advice. Information presented on the Site may not reflect the most current legal developments and may not be applicable to your specific circumstances. You should not rely upon information presented on the Site for any purpose without first consulting an attorney licensed to practice in your jurisdiction.
3. No Attorney-Client Relationship
Use of the Site, transmission of information through the Site (including through the intake form), and communication with the firm by email or telephone do not create an attorney-client relationship between you and Consumer Lit. An attorney-client relationship is formed only upon the firm’s written agreement to undertake representation, evidenced by a fully executed engagement agreement.
4. Confidentiality of Inquiries
Information submitted through the Site or transmitted to the firm prior to the formation of an attorney-client relationship is not protected by the attorney-client privilege. Although the firm treats prospective-client inquiries with discretion in accordance with California Rule of Professional Conduct 1.18, you should not transmit confidential or sensitive information to the firm until an attorney-client relationship is formed.
5. Prior Results
Any reference on the Site to verdicts, settlements, awards, recoveries, or other case results refers to past results and does not guarantee or predict a similar outcome in any future matter. Each case turns on its own facts.
6. Communications: Telephone, SMS, and Email
By submitting our intake form and selecting the corresponding consent boxes, you authorize Consumer Lit and its agents to contact you by telephone, text message (SMS), or email at the number and address you provide for the purposes you have consented to (marketing, informational/case-related, or telephone calls, including autodialed and pre-recorded calls). Consent to receive these communications is not a condition of representation. Standard message and data rates may apply. You may withdraw consent at any time:
- SMS: reply “STOP” to any text message.
- Email: follow the unsubscribe instructions in any commercial email.
- Telephone: request placement on the firm’s internal do-not-call list by contacting info@consumerlit.com.
7. Intellectual Property
All content on the Site, including text, graphics, logos, images, and the compilation thereof, is the property of Consumer Lit or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws. You may view and download Site content for your personal, non-commercial use only. Any other use, including reproduction, modification, distribution, or republication, is prohibited without the prior written consent of Consumer Lit.
8. Acceptable Use
You agree not to use the Site to: (a) violate any applicable law or regulation; (b) transmit any material that is false, defamatory, harassing, or otherwise unlawful; (c) interfere with or disrupt the Site or its servers; (d) attempt to gain unauthorized access to any portion of the Site; or (e) submit information on behalf of another person without that person’s authorization.
9. Third-Party Links and Content
The Site may contain links to websites operated by third parties. Those websites are not under the control of Consumer Lit, and we are not responsible for their content, accuracy, or practices. The inclusion of any link does not imply endorsement.
10. Disclaimer of Warranties
The Site and all content on it are provided on an “as is” and “as available” basis. To the fullest extent permitted by California law, Consumer Lit disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, completeness, and non-infringement.
11. Limitation of Liability
To the fullest extent permitted by California law, in no event shall Consumer Lit, its attorneys, or its employees be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or in connection with your access to or use of the Site, even if Consumer Lit has been advised of the possibility of such damages. Nothing in these Terms is intended to limit a lawyer’s liability to a client for the lawyer’s professional misconduct, as prohibited by California Rule of Professional Conduct 1.8.8.
12. Indemnification
You agree to indemnify, defend, and hold harmless Consumer Lit and its attorneys, employees, and agents from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms or your misuse of the Site.
13. Jurisdictional Limitations
The attorneys of Consumer Lit are licensed to practice law in the State of California. Consumer Lit does not seek to represent any person residing in, or based on activity occurring in, a jurisdiction in which the firm is not authorized to do so. The Site is not intended to be advertising or solicitation in any jurisdiction in which it would be prohibited.
14. Governing Law and Venue
These Terms and any dispute arising out of or relating to them or your use of the Site shall be governed by the laws of the State of California, without regard to its conflict-of-laws principles. The exclusive venue for any action arising out of or relating to these Terms or the Site shall be the state and federal courts located in Los Angeles County, California, and you consent to the personal jurisdiction of those courts.
15. Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
16. Modifications
Consumer Lit may revise these Terms from time to time by posting an updated version on the Site. The “Effective Date” above will reflect the date of the most recent revision. Your continued use of the Site following the posting of revised Terms constitutes acceptance of those revisions.
